TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM AND ALL CONTENT, DATA, RESEARCH, MATERIALS, SOFTWARE, INFORMATION, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
FONTAVIS DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Nothing in these Terms limits rights that cannot legally be excluded under applicable law.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FONTAVIS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING FROM OR RELATED TO YOUR ACCESS TO OR USE OF THE PLATFORM.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FONTAVIS'S TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO FONTAVIS FOR THE APPLICABLE SERVICES DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS ($100).
These limitations apply regardless of the legal theory underlying the claim, including contract, negligence, or other theory, even if Fontavis has been advised of the possibility of such damages.
Some jurisdictions do not permit certain limitations of liability. In those jurisdictions, applicable limitations will apply only to the extent permitted by law.
You agree to indemnify, defend, and hold harmless Fontavis and its affiliates, officers, directors, employees, agents, licensors, and service providers from and against claims, liabilities, damages, judgments, losses, costs, expenses, and reasonable attorneys' fees arising from or relating to:
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict-of-law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its applicable rules.
The arbitration shall take place in Washington, D.C., unless otherwise required by applicable law or agreed by the parties.
The arbitrator's decision shall be final and binding to the extent permitted by applicable law.
To the extent permitted by applicable law, you agree that disputes will be resolved on an individual basis and not as part of a class, consolidated, or representative action.
Either party may seek injunctive or other equitable relief in a court of competent jurisdiction where necessary to protect intellectual property, confidential information, security interests, or prevent irreparable harm.

The "Last Updated" date displayed on this page indicates when these Terms were most recently revised.
Your continued use of the Platform after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
These Terms, together with the Privacy Policy, Cookie Policy, and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Fontavis regarding your use of the Platform.

Fontavis shall not be liable for delays or failures caused by circumstances beyond its reasonable control, including natural disasters, war, terrorism, civil disturbances, government actions, telecommunications failures, cybersecurity incidents, network failures, infrastructure failures, or other events beyond reasonable control.
